FDA Should Enforce the Law and Order Immediate Removal of All Unauthorized Synthetic Nicotine Products

WASHINGTON, D.C. – The FDA rightly recognizes that, as of a July 13, 2022, deadline set by Congress, all unauthorized synthetic nicotine products are now illegal and cannot be legally marketed or sold in the United States. None have been authorized to date. However, sending a small number of warning letters does not comply with the law. Anything short of ordering manufacturers, distributors and retailers to immediately pull all unauthorized synthetic nicotine products is unacceptable and a violation of FDA’s obligation to enforce the law.
